RECEPTION#: 798581, 01/21/2009 at 09:09:09 AM, 1 OF 2, RES FRANCINE <br />TIPTON-LONG, MONTROSE COUNTY, CO CLERK AND RECORDER <br />i <br />RESOLUTION NO. 6-2009 <br />OF THE MONTROSE COUNTY BOARD OF COUNTY COMMISSIONERS <br />CONCERNING: SPRING CREEK PIT EXPANSION SPECIAL USE (SU-08-0048) <br />WHEREAS, the Board of County Commissioners considered the Spring Creek Pit Expansion Special Use at <br />their regularly scheduled meeting on January 20, 2009. <br />WHEREAS, the Board of County Commissioners APPROVED the Spring Creek Pit Expansion Special Use. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Montrose, <br />State of Colorado that the Spring Creek Pit Expansion Special Use submitted by Oldcastle SW Group, Inc. is <br />hereby APPROVED with the following: <br />Findings of Fact: <br />a) Upon completion and/or implementation of the required conditions, the proposal will meet the <br />standards of the Montrose Zoning Resolution, Section C - Gravel Mining Mitigation Standards <br />b) The proposed Gravel Pit is allowed by Special Use in the General Agricultural Zoning District. <br />c) The expansion will not increase operations at the site. <br />Conditions of Approval: <br />1. The gravel pit shall be subject to all applicable mitigation standards as outlined in Montrose Zoning <br />Resolution, Section C - Gravel Mining Mitigation Standards. <br />2. The Special Use Permit shall adhere to all requirements of any County, State or Federal Agency. <br />3. A new driveway access permit shall be obtained for access to LaSalle Road. Any improvements <br />required as a part of the access permit shall be completed prior to operations in the expansion area. <br />4. All lighting within the SUP area shall be down directed and fully shielded. <br />5. The permit shall be applicable only to the specific use and specific property for which it was issued. <br />6. The Special Use Permit shall run with the land. <br />7. Activities of any type within the SUP area shall be prohibited outside the allowed hours of operation <br />as outlined in the Gravel Mining Mitigation Standards, except those activities directly related to security <br />shall be allowed at all times. <br />8. Approval of this permit does not limit the County Commissions power to terminate this permit, if a <br />finding of non-compliance with the provisions of the permit, Zoning Resolution or other laws of the <br />County, State or Federal Government. <br />9. A Boundary Survey documenting the area of the SUP shall be submitted to the Planning and <br />Development Department within 45 days after BOCC approval. <br />10. United will be allowed to run a whisper watt (or similar) generator at night during the months of <br />December, January and February, when the temperatures are expected to drop below 20° F and when <br />a crushing unit is located within the SUP area. This generator will not be located any closer than 400 ft <br />from any permit boundary. <br />11. United will be allowed to perform light maintenance activities (i.e. oil and lubricant changes, belt <br />changes, conveyor roller changes, etc.) between the hours of 6:30 am to 7:00 am and between 6:00 <br />pm and 8:00 pm. <br />APPROVED AND ACCEPTED this 20th day of January, 2009.
