Division Director <br />Re: Follow-up on Unresolved Problem at Ghost River Gravel Pit; Permit Number M-2003-002 Natural Resource Trustee <br />Dear Mr. Melvick: <br />The above-mentioned site has had one or more problems noted that, according to Division of Reclamation, Mining <br />and Safety (Division) records have not yet been resolved. According to our records, the following problem was to be <br />resolved on or before June 30, 2009. Listed below are descriptions and corrective actions for the problem. Please <br />resolve the corrective actions and provide evidence of such resolution on or before September 25, 2009. <br />Please note that if the corrective action is not properly addressed, and evidence provided to the Division by the date <br />provided above, the listed problems could be escalated to the level of possible violations and would then be referred <br />to the Mined Land Reclamation Board for further action. <br />• During the inspection, it was discovered that there is not adequate vegetative cover on the topsoil <br />stockpile. This is a problem related to Section 3.1.9(1) of the Construction Materials Rules and Regulations <br />for failure to employ vegetative cover or other means to protect topsoil from erosion, keep it free of any <br />contamination by toxic or acid-forming material, and maintain it in a useable condition for reclamation. <br />CORRECTIVE ACTION: <br />• Seed the topsoil with vegetative cover at the next appropriate seeding time for your area and send the <br />seed receipts to the Division for verification. <br />If the problem has already been remedied, please provide evidence of its completion.
