<br />h. To provide envitoamental health services and to assess foes to offset the actual, direct cost of such services; and
<br />i. To accept and, through the public health director, to use, dish-, and administer all federal aid, state aid, or other property, services, or moneys
<br />allotted to an agency for district public health functions or allotted without designation of a specific agency for purposes that are within the
<br />functions of an agency, and to prescribe, by tide consistent with the laws of this state, the conditions under which the property, services, or
<br />moneys shall be accepted and administered. The district board of health is empowered to make agreements that may be requited to receive such
<br />moneys or other assistance.
<br />Section 10. The Northeast Colorado Health Deparmtent, subject to available appropriations, shall provide or arrange for the provisions of services
<br />necessary to carry out the public health laws and rules of the state board of be" the water quality control commission, the at quality control commission,
<br />and the solid and hazardous waste commission according to the specific nods and resources available within the community as determined by the district
<br />board of health and as set out in both the comprehensive, statewide public health improvement plan developed pursuant to C.R.S. 125-I-504 and the district
<br />public health plan developed pursuam to C.R.S. §25-1-505.
<br />Section 11. In addition to other powers and duties, an agency shall have the following duties:
<br />a. To complete a community health assessment and to create the district public health plan at least every five years under the direction of the county
<br />or district board and to submit the plan to the district board and state board for review;
<br />b. To advise the county or district board on public policy issues necessary to protect public health and the environment;
<br />C. To provide or arrange for the provision of quality, core public health services deemed essential by the state board and the comprehensive,
<br />statewide public health improvement plan, except that the agency shall be deemed to have met this requirement if the agency can demonstrate to
<br />the county or district board that other providers offer core public health services that are sufficient to most the local nods as determined by the
<br />plan;
<br />d. To the extent authorized by the provisions of this title or article 20 of title 30, C.R.S., to administer and enforce the laws pertaining to public
<br />health, air pollution, solid and hazardous waste, and water quality; vital statistics; and the ordus, tides, and standards of the state board of health
<br />and any other type 1 agency created pursuant to the provisions of Title 25 of the Colorado Revised Statutes;
<br />e. To investigate and control the causes of epidemic or communicable diseases and conditions affecting public health;
<br />f. To establish, maintain, and enforce isolation and quarantine, and in pursuance thereof, and for this purpose only, to exercise physical control over
<br />property and over the persons of the people within the jurisdiction of the agency as the agency may fond necessary for the protection of the public
<br />health;
<br />g. To close schools and public places and to prohibit gatherings of people when necessary to protect public health;
<br />IL To investigate and abate nuisances when necessary in order to eliminate sources of epidemic or communicable diseases and conditions affecting
<br />public health;
<br />i. To establish, maintain, or make available chemical, bacteriological, and biological laboratories, and to conduct such laboratory investigations and
<br />examinations as it may deem necessary or proper for the protection of the public health;
<br />j. To purchase and distribute to licensed physicians and veterinarians, with or without charge, as the county or district board may determine upon
<br />considerations of emergency or need, approved biological or therapeutic products necessary for the protection of public health;
<br />k To initiate and carry out health programs consistent with state law that are necessary or desirable by the district board of health to protect public
<br />health and the environment;
<br />1. To collect, compile, and tabulate reports of marriages, dissolutions of marriage, and declarations of invalidity of marriage, births, deaths, and
<br />morbidity, and to require any person having information with regard to the same to make such reports and submit such information as is required
<br />by law or the rules of the state board;
<br />in. To make necessary sanitation and health investigations and inspections, on its own initiative or in cooperation with the state department, for
<br />matters affecting public health that are within the jurisdiction and control of the agency; and
<br />n. To collaborate with the state department and the state board in all matters pertaining to public health, the water quality control commission in all
<br />matters pertaining to water quality, the air quality control commission and the division of administration of the state department in all matters
<br />pertaining to air pollution, and the solid and hazardous waste commission in all matters pertaining to solid and hazardous waste.
<br />Section 12. If the district board of health does not receive sufficient appropriations to fulfill all the duties desenlW in Section I 1 of this
<br />agreement, district board of health shall set priorities for fulfilling the duties and shag include the list of priorities in its district public health plan submitted
<br />pursuant to C.R.S. §25-1-505.
<br />Section 13. The board of health shall have the full power and authority to acquire property, both real and personal, to fulfill its purposes, and to
<br />adopt rules and regulations for conduct of its affairs and the affairs of the Northeast Colorado Health Department, and such other power as is authorized by
<br />C.R.S. §25-I-711, as now in effect, or as may hereafter be amended. To provide for economy of obtaining services, supplies, or other property. the board of
<br />health and the member counties may agree to have one or more of the member counties acquire or contract on behalf of the board of health for the
<br />acquisition of such services, supplies or other property. The member counties are obligated to obtain and maintain insurance coverage for the property and
<br />functions of the Northeast Colorado Health Department.
<br />Section 14. The district health department organized and constituted by this intergovemmantal agreement shall be the full legal successor without
<br />any period of lapse to the existing Northeast Colorado Health Department organized and authorized by the 1988 intergovernmental agreement as to all legal
<br />obligations and authority of every kind including but not limited to contracts, grams, employment of existing employers, assets, and debts.
<br />Section 15. The board of health, before September I of each year, shall estimate the total cost of maintaining the department for the ensuing fiscal
<br />year and the monies that may be available from onexpanded surplus, from state or federal fads, or other grams or donations. Said estimate sball then be
<br />submitted in the form of a budget to the boards of county commissioners of all counties that are party to this intergovernmental agreement. The cost of
<br />maintaining the department of bmhh over estimated monies from surpluses, grams or donations "be apportioned among the counties comprising the
<br />health department in the proportion that the population of each member county bears to the total population- of- all member coumis, with population figures
<br />to be based- on the last federal census. The boards of county commissioners of the respective counties shall then provide any monies necessary to covertheir
<br />proportionate share by appropriation from the county general funds.
<br />Section 16. For the purpose of Wing formulas generated by state and federal agencies, when the formula or funding mechanism is based upon a
<br />county by county basis, each county within the NCHD district shall be considered to be a separate county, entitled to the fill funding allocated to every
<br />county within the State of Cootado. When a formula for allocating fords to a district as a whole the amount allocated to the NCHD shall be equal to or
<br />greater than the total funds which would be allocated to each county if such county had created an individual county health department and had been
<br />allocated its full share. This paragraph shall be applied on a program by program basis and shall be reviewed each time the State of Colorado changes or
<br />adjusts an allocation formula or program fiscal year renews. The counties signatory to this agreement authorizes and empowers the Public Health Director
<br />or the Director's designee to review and accept or deny requests by the State of Colorado for any temporary variance or suspension from the provisions of
<br />this paragraph in order to accomplish the goals of a particular public health program or state activity.
