This document presents the results of the Division's Midterm Review of the Seneca Baal <br />arnpany} Seneca ?X Mine permit, Tl]1s Mldtea?n Review ??? conducted to fu1f111 the <br />requirements ofRules ?.oS,, 2.??.??]o?, ?io6.??4?, Z.o?,7{} and 3.0?.??4}. <br />Rule ?.o8i? requires that the Division conduct a review of each permit issued, prior to its <br />midterm ?2 ?I? years}. Based on this review, far goad cause shown, the D?v1s10n may require <br />reasonable revisions or modi?iGatians of the permit provisions to ensure compliance with the ,Act <br />and Regulations. <br />Rules ?.0?.?, ?.0?.3, ?,oG.S and ?.a?.? require that experimental practices, mountaintop removal, <br />variances from approximate original contour ???} and variances from conten?paraneous <br />reclamation, respectively, be reviewed ?]? the D1v?lon where applicable during the Midterm <br />Review. q'he Seneca II 1Vline does not have any experimental practices ar any variances from <br />n?auntaintop removal or ADS. I?owever, the Division previously granted a variance from <br />Go?ater?]poraneous reclamation see eCtlal] V ofthls document}. <br />Rule ?,??.??4? requires that the Drvlsio?. review the amount afthe bond and the terns of <br />accepta?ace ofthe bond every Z ?l? years. ?. dull cost estimate review is currently being conducted <br />far Bond Release Appllcatlo?a ?-4. The bond release inspection for L-? was done in July ?oOS <br />and the Proposed Decision and Findings of ampliance are pending. inGe a east estimate review <br />is in progress for SI?-4, a separate review will not be conducted far this Midterm Review. <br />This Midterm Review AMT-} consisted of a detailed review of the Seneca II Mine permit <br />application and Findings Document to identify any items that may have been overlool?ed during <br />the initial review. The Division also reviewed all subsequent revisions and stipulation re?panses <br />to ensure that all permit COnlm1tr17ents and conditions were being followed. Observations and <br />any problems noted frarn past inspection reports were also considered. <br />ETI?N? I - I?ITO?? ?? SITS <br />The eneGa II 1Vline is a surface coal mine located approximately 9 miles southeast ofHayden, <br />olorada in Routt bounty, foal interet is federal, state, and private, and the surface affected is <br />state and private land. The permit area encompasses approximately ,?57 acres, of which <br />approximately l,S7a acres have been disturbed by surface operations. <br />On ,August 2, ?oo?, Seneca ?aa1 company submitted an application to renew the valid, existing <br />permit for surface mining operations at the Seneca II Mine. The Division issued its Proposed <br />Decls?on and F?ndings of onrzpl?ance to approve the appllGat?on an March ??, X007. The ?ive- <br />yearpermit term was renewed effective February 17, 2007, and will expire an February 17, X012. <br />Mining operations have been completed at the Seneca II Mine. The wolf creek and wadge Aac`ea <br />pits have all been entirely bacl?filled and graded, construction of post mine drainage channels has <br />been completed, topsail has been redistributed, and seeding and planting has been can?pleted i?a <br />all locations Of the rnlne site, ?noing n?alntenanGe of sedlrnentatlon ponds,past mine drainage
