RD &D Project, Notice of Intent (NOI) P-2008-046, 2nd Notice of <br />Deficiency, MD-02. <br />Dear Mr. Day, <br />The Division of Reclamation, Mining and Safety (DRMS) has reviewed the response submitted by <br />American Shale Oil, LLC to address the Notice of Deficiency for the application for modification to the <br />Notice of Intent to Conduct Prospecting Operations (NOI), No. P-2008-046. The application cannot be <br />approved until the following issues are adequately addressed. <br />The application does not include up gradient monitoring wells for either the B-Groove or the <br />Wasatch formations on the MWP Pad. Please justify why five (5) quarters of baseline sampling <br />is not proposed for the B-Groove and Wasatch. In the event of contamination of the down- <br />gradient wells, will the applicant assume the source of contamination is from the American Shale <br />Oil, LLC RD & D Project? <br />• Please provide the Division a cost estimate for four (4) quarters of hydrologic sampling from a <br />qualified environmental contractor. The figures will be used to estimate an accurate reclamation <br />cost estimate. <br />This letter shall not be construed to mean that there are no other technical deficiencies in your application. Please <br />submit a response to the issues as soon as so the decision date of August 31, 2009 can be met.
