III. COMMENTS - COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
This was a partial coal inspection conducted by Jason Musick of the Colorado Division of
Reclamation, Mining, and Safety(Division) on 17 August 2009. The weather was clear and the mine
site was dry during the on-the-ground inspection.
Hydrologic Balance
The Load Out pond was holding water with no discharge at the time of the inspection. The pond
embankments were stable and well vegetated with no problems or maintenance concerns noted.
Reclamation Success
Vegetation at the Load Out is in good condition. The vegetation provides good cover and stability
with no weed patches evident.
Wildlife
Eight to Ten ducks along with one Blue Heron were observed on the Load Out pond. No problems
were noted in reference to wildlife in the Load Out area.
