III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division) on 18 August 2009. The weather was clear and the mine <br /> site was dry during the on-the-ground inspection. Jerry Nettleton of Twentymile Coal Company <br /> accompanied the inspection. <br /> The longwall mining was operating as permitted in panel 24 in the northern mining district at the time <br /> of the inspection. Development mining was being conducted in panels 16 left and 17 left in the <br /> western mining district. No drilling activities were in progress during the inspection. Coal was not <br /> being loaded out onto trains, although a -103 car train arrived at the site during the inspection. <br /> Roads <br /> Haul roads and access roads were stable and in good condition at the time of the inspection. Roads <br /> in and around the facilities areas were being watered at the time of the inspection. Roadside ditches <br /> throughout the facilities area were stable and no problems were noted. Roadside ditch E-2-B near <br /> the Fan and Utility Building identified on Map 24 was in the process of cleaning at the time of the <br /> inspection. <br /> Hydrologic Balance <br /> Ponds G, F, E, C, B, D, and 6MN were observed during the inspection. Pond 61VIN was holding runoff <br /> water with no pumping occurring. Pond D was discharging and water was flowing from Pit 1 to Pond <br /> D. All Ponds embankments were stable and well vegetated at the time of the inspection. <br /> No discharge was occurring from the Fish Creek Bore Hole ponds. Extra piping and non-coal waste <br /> should be cleaned up in and around the area of the ponds. <br /> The sump on the north side of the access ramp at Pond B appeared to be stable and functioning as <br /> designed with no problems noted. <br /> Processing Waste <br /> Waste material placement was being conducted at the time of the inspection. The refuse areas were <br /> stable and appeared to be stable with no problems noted. The RDA 100-year ditch on the north side <br /> of the refuse pile will be addressed within the week of this inspection according to Jerry Nettleton. No <br /> other problems were noted in regard to the ditches directed from the refuse area to Pond D. <br /> Support Facilities <br /> The construction at the 18LT ventilation shaft pad area continues with no problems noted. Erosion <br /> control structures appeared to be functioning as designed. Both boreholes were in the process of <br /> drilling with no problems. <br /> Rock dust tanks N of CR 27 appeared to have some dust spillage evident. Jerry Nettleton mentioned <br /> that new dust collectors have been obtained and need to be installed. The spilled dust will need to be <br /> addressed. <br />
