Further background on RMCC's Fulton Ditch shares was given in the <br />December 18, 2006 SWSP request. <br />Other Stored Water <br />Additional replacement requirements will first be provided by water that RMCC has in storage <br />(110 ac-ft at the beginning of June 2009). Releases from storage for the Bromley Lakes Pit <br />replacements are shown in Table 113, Column [16]. Total required storage releases for all three <br />pits are shown in Table 2, Column [6]. RMCC's portion of Kenneth Mitchell evaporation was <br />estimated based upon conservative storage projections provided by the City of Brighton. <br />Lease Water <br />Any remaining replacement requirement will be replaced by water leased from the City of <br />Brighton as shown in the Table IB, Column [18]. The City of Brighton will either make releases <br />from Kenneth Mitchell Lake or will provide augmentation water from other sources approved by <br />the Water Commissioner. Brighton's agreement to lease water to RMCC is attached. <br />OPERATION OF PLAN <br />In order to prevent injury to other vested water rights, RMCC proposes to operate the SWSP for <br />the Bromley Lakes Pit under the following terms and conditions: <br />1. The total surface area of exposed groundwater at the Bromley Lakes Pit shall not exceed <br />44 acres. <br />2. RMCC will measure and deliver 25 shares of Fulton Ditch released directly to the river or <br />delivered to storage at Kenneth Mitchell Lake. All releases from storage will also be <br />measured before delivery into the South Platte River. <br />3. The Fulton shares committed to this SWSP shall not be sold or leased to any other entity. <br />The Fulton shares shall remain appurtenant to the Bromley Lakes site (Ready Mixed Pit <br />1, Bromley Lakes Pit, and North Tower Pit) until the plan for augmentation is obtained. <br />4. The contact person for purposes of this SWSP, who will be responsible for operation and <br />accounting of this plan, shall be Julia Keedy in our office. She can be reached at the <br />letterhead address and phone number, and her email address is jkeedynabbawater.com. <br />Tables IA and 111 give the individualized monthly accounting for the pit's out-of-priority <br />depletions and replacement sources. The Fulton Ditch credits will be released to the river in the <br />summer months in order to replace all out-of-priority depletions. The excess Fulton Ditch credits <br />will be diverted to storage in order to be used for wintertime releases.
