Brogden <br />Re: Renewal Request for Substitute Water Supply Plan (SWSP) for Ready Mixed Concrete <br />Company - Bromley Lakes Pit (M-1987-049) Pursuant to 37-90-137(11). <br />Dear Dick: <br />We are submitting a renewal request for the Bromley Lakes Pit SWSP on behalf of our client <br />Ready Mixed Concrete Company (RMCC). The previous SWSP renewal request was submitted <br />on March 14, 2008 in order to cover depletions from August 2008 through February 2009. On <br />February 4, 2009, we provided updated tables to the State with projected depletions through July <br />2009 so that the SWSP would cover operations through July 2009. We provided the updated <br />tables, after discussions with the State, in order to have the SWSP approval periods coincide for <br />all three pits at the Bromley Lakes Site. We have not received a response to the renewal request. <br />It is our desire to have all three pits on the same approval track so we can more plainly show the <br />joint operation of RMCC's Fulton Ditch shares and stored water. Several operational changes <br />have occurred since our previous request was submitted as outlined below. <br />1. RMCC is storing their excess Fulton Ditch water in Kenneth Mitchell Lake (formerly <br />Cell 1 of the Bromley Lakes Pit) which is now operated by the City of Brighton, rather <br />than Erger's Pit. <br />2. RMCC is replacing winter depletions with releases from Kenneth Mitchell Lake or <br />delivery of other augmentation supplies to the river acceptable to the water <br />commissioner. The releases will be made from either RMCC's pool in the lake, or <br />according to a lease of augmentation water from the City of Brighton. <br />PROJECT DESCRIPTION <br />The Bromley Lakes Pit is roughly a 140-acre pit located between the South Platte River and the <br />City of Brighton, consisting of Cells 2 and 3 (see Figure 1). This pit is part of a 600-acre site <br />known as the Bromley Lakes Site.
