25. There shall be no more than six trucks for the clay
operation exiting or entering the mine during each
operating day.
26. Mining and reclamation shall occur according to the time
tables as set forth on the maps and diagrams submitted with
the application. The sand and gravel operator shall begin
mining in Stage 1 in the southeast portion of the mine and
finish mining in Stage 7 in the northwest portion of the
mine. When Stage 1 is complete, mining will start in Stage
2 with reclamation beginning in the previously mined Stage
1, when enough room is available in Stage 2 to move the
processing equipment. This procedure will follow for each
stage until the mining is complete. Based on the removal
estimate of 150,000 tons per year, each mining stage would
last between three and five years. Each reclamation phase
shall be completed within five years.
The applicants shall comply with all regulations and
requirements of the Colorado Mined Land Reclamation Board
governing reclamation. The follow-up maintenance of the
final reclamation shall be continued until growth is
self-sustaining.
27. A copy of the performance bond provided to the Colorado
Mined Land Reclamation Board shall be filed with the Board
of Adjustment before any mining occurs.
28. The applicant shall furnish the Board of Adjustment with
two copies of certificates of insurance which are
acceptable and approved as to form and content by the
County Attorney's Office within thirty days from the date
of this Resolution or prior to commencing operation.
Certificates of Insurance shall contain a provision for a
ten (10) day written notice to the County of any
cancellation or any material change in the policy.
Said insurance shall be comprehensive general liability and
automobile liability insurance affording coverage for all
claims for bodily injury including death and all claims in
connection with any operations pursuant to granting this
temporary use, whether such operations be by the applicant
or by subcontractors under it, or anyone directly or
indirectly employed by the applicant or by a subcontractor
under it.
8
