JAMES moved that the following Resolution be <br />adopted: <br />Case No. <br />BEFORE THE BOARD OF ADJUSTMENT <br />OF THE COUNTY OF JEFFERSON <br />STATE OF COLORADO <br />RESOLUTION <br />M87-1 <br />Applicant: Marcus F. Church Estate, mineral <br />rights owner and applicant for <br />sand and gravel operation. <br />Department of Energy, surface <br />owner <br />Location: Parcel of land located in Section <br />9, Township 2 South, Range 70 West <br />of the 6th P.M., Jefferson County, <br />Colorado, as more fully described <br />in the application containing <br />223.43 acres, more or less. <br />Request: Request for a special exception <br />to mine sand, gravel, and <br />possibly clay in a Mineral- <br />Conservation (M-C) Zone District <br />for the Life of the Mine <br />operation. <br />WHEREAS, on November 6, 1986, Marcus F. Church Estate filed a <br />Board of Adjustment Case No. M87-1 as an application for the <br />temporary use of land for open mining of sand, gravel, and <br />possibly clay in a Mineral-Conservation (M-C) Zone District <br />under the Jefferson County Zoning Resolution for the life of the <br />mine; and <br />WHEREAS, on April 22, 1987, full and complete hearings were held <br />before the Board of Adjustment with all parties having a right <br />to call witnesses, introduce exhibits, and cross-examine all <br />witnesses called to testify; and <br />WHEREAS, the subject property was properly posted as shown by <br />the Jefferson County Zoning Department's Affidavit of Posting in <br />the file and by testimony of the applicant and Board members; <br />and <br />1
