Cattany <br />Division Director <br />Natural Resource Trustee <br />f <br />Re: Albert Frei & Sons, Inc., Frei Pit No. 3, Acreage Reduction Approval, Permit No. M-1979-165 <br />Revision No. AR-1 <br />Dear Mr. Frei: <br />On August 14, 2009, the Colorado Division of Reclamation, Mining and Safety (Division) approved your request for <br />release of a portion of the permit area from further reclamation responsibility. <br />The permit area was reduced to 1.87 acres, through the release of 12.33 acres in this permit action. The financial <br />warranty for the permitted area has been reduced from $66,800 to $2,836. The Division records indicate that Albert <br />Frei and Sons, Inc. holds a Letter of Credit for the Financial Warranty at the site.
