Sherman
Executive Director
Ronald W. Cattany
Division Director
Natural Resource Trustee
I have reviewed the application for Minor Revision MR-53 for the Edna Strip Mine. Here are my
adequacy comments. As today is the last day of the 10-day review period for this Minor Revision,
please provide us with a request for an extension of the decision due date to some date in the future
that would provide WWC Engineering with time to submit the requested information to our offices
and time for us to review it.
1. Please provide the information required by Rules 2.05.5(1)(a)(iii) and 2.05.5(1)(b) requiring
comments from surface owners and State and local agencies regarding the proposed retention
of the West Ridge diversion ditch.
2. Rule 4.05.3(3) requires permanent diversions to safely pass the peak runoff from a 10-year,
24-hour storm event. Page 4.6-96 of the Edna Strip Mine states that the West Ridge diversion
ditch "was designed to route inflow due to a 10-year, 24-hour storm and pumping from the
pits from West Ridge drainage area into the sediment pond". This item is therefore addressed.
At this time, I have no further adequacy concerns. I await your responses to Question #1 above.
Please feel free to contact me at 303-866-4933 or daniel.hemandez(&state.co.us if I may answer any
questions you may have.
Sincerely,
r
Daniel I.
