<br />requesting release of Phase I bond liability on
<br />152.6 reclaimed acres of its total 4,093.0 acres cur-

<br />rently within the permit boundary at the Seneca II-W
<br />Mine (CDRMS Permit No. C-82-057, approved De-
<br />cember 1985). A surety bond in the amount of
<br />$1
<br />511,117,348 is is currently in place of which $4,864,928
<br />are being requested for release.
<br />The Seneca II-W Mine is located approximately
<br />seven (7) miles south of the Town of Hayden, Colo-
<br />rado off of RCR M 53. The specific area to which this
<br />bond reuse request applies is included within the
<br />Permit Area located as follows:

<br />The USGS 7.5 Minute Quadrangle Maps of Hayden
<br />Gulch, Hayden, Dunckley, and Mt. Hams, contain the
<br />described permit area.
<br />Pursuant to Rule 3.03.1, a permittee may request
<br />Phase I Bond release upon successful completion of
<br />backfilling, regrading and drainage control in accord-
<br />ance with the approved reclamation plan. Those
<br />portions of the mine for which Phase I bond release
<br />is requested were backfilled and graded from the be-
<br />ginning of mining, in 1990, through 2008 in accord-
<br />ance with the Colorado Division of Reclamation, Min-
<br />ing and Safety (CDRMS) rules and regulations. The
<br />approved reclamation plan can be reviewed in its en-
<br />tirety in the Seneca II-W Mine Permit Application
<br />Package located in the Hayden Public Library, Hay-
<br />den, Colorado.
<br />For the purposes of this Phase I Bond Release re-
<br />quest, the term "reclaimed" means those
<br />disturbed/mined areas where successful completion
<br />of backfilling, regrading and drainage control, in ac-
<br />cordance with the approved reclamation plan, has
<br />been completed.
<br />Backfilling and grading was conducted from 1990
<br />through 2008. All areas affected by the surface min-
<br />ing operations, except as specifically exempted by
<br />the CDMG, were regraded on a timely basis to a sta-
<br />ble configuration that conforms to the approved
<br />postmining land use (livestock grazing and wildlife
<br />habitat). The Phase I reclamation activities have pro-
<br />duced a stable landform in compliance with the ap-
<br />proved conditions in the CDRMS Permit No.
<br />C-82-057.

<br />available for public inspection at the Hayden Public
<br />Library, 201 E. Jefferson Avenue, Hayden, Colorado
