<br />All located west of the 6th Principal Meridian; totaling 4,093 acres. The USGS 7.5 Minute Quadrangle Maps
<br />of Hayden Gulch, Hayden, Dunckley, and Mt. Harris, contain the described permit area.
<br />SCC is applying for Phase I release on 1,166.2 acres. A reclamation bond in the amount of $11,117,348 is
<br />currently in place of which $4,864,928 are being requested for release.
<br />Pursuant to Rule 3.03.1, a permittee may request Phase I Bond release upon successful completion of
<br />backfilling, regrading and drainage control in accordance with the approved reclamation plan. For the
<br />purposes of this Phase I Bond Release request, the term "reclaimed" means those disturbed/mined areas
<br />where successful completion of backfilling, regrading and drainage control, in accordance with the approved
<br />reclamation plan, has been completed. The areas requested for bond release were backfilled and graded from
<br />the beginning of mining, in 1990 through 2008 in accordance with the Colorado Division of Reclamation,
<br />Mining and Safety (CDRMS) rules and regulations.
<br />The Phase I reclamation activities have produced a stable landform in compliance with the approved
<br />conditions in the CDRMS Permit No. C-82-057. The majority of the grading work was performed with
<br />dozers and scrapers. In some cases the major backfilling was done with draglines. All areas affected by the
<br />surface mining operations, except as specifically exempted by the CDRMS, were regraded on a timely basis to
<br />a stable configuration that conforms to the approved post-mine land use (livestock grazing and wildlife
<br />habitat). Rill and gully surveys are conducted annually- in the spring of each year to identify areas that have
<br />experienced severe erosion or other signs of instability during spring runoff from snowmelt and precipitation
