Cattany <br />Division Director <br />Amarillo, TX 79118 Natural Resource Trustee <br />RE: Wiley Pit; DRMS File # M-1977-223; Request for File Information <br />Dear Mr. Munsell: <br />In response to your inquiry concerning whether or not there has been, or will be, a Colorado <br />Cultural Resources Inventory conducted on the Wiley Pit, we have conducted a file review and have <br />the following information. The site was permitted in 1977 indicating that it was permitted during <br />the first year the Mined Land Reclamation Act was in effect. At that time notification and <br />clearance from the Colorado State Historic Preservation Office may not have been required during <br />the permitting process. As a result, unless the applicants chose to conduct a cultural resource <br />inventory, it was probably not done. Consequently, we have no record of a cultural resource <br />inventory for the Wiley Pit. <br />Presently, at the time we receive a complete application or amendment to an application and <br />officially begin our review, notices are sent out to a number of local, state and federal agencies <br />informing them of the proposed mining application. Included in that list is the Colorado Historical <br />Society. They typically conduct a search of the Colorado Cultural Resources Inventory, based on <br />the legal description included in the permit or amendment application. They then inform us in <br />writing if there are any known cultural resources or if a cultural survey has been conducted in that <br />area. <br />It is my understanding that you will be submitting an amendment to your existing permit in the near <br />future. At that time, the Colorado Historical Society will be noticed, a review of the Colorado <br />Cultural Resources Inventory will be conducted, and we will be notified if there are any resources <br />of historical or cultural significance within your proposed permit area at that time. <br />I trust this will sufficiently addresses your inquiry.
