The Colorado Department of Public Health and Environment is the regulatory agency <br />responsible for the only other permit held for the Edna Mine. A copy of the certified <br />letter notifying them of a name change is attached. <br />2. A draft public notice is attached. <br />3. An updated chain of ownership and officers and directors of each company in the <br />chain are attached as part of the response to concern five of your letter. <br />4. Our attorney is drafting a response to this particular request. He is traveling this week <br />and out for the holiday next week. He said he would try to have something to me by <br />the end of this week but, if not, it will be after January 1. Essentially I think he is <br />going to propose some sort of statement to insert in the section that says the company <br />changed names and any reference to P&M or The Pittsburg & Midway Coal Mining <br />Co. should be considered a reference to Chevron Mining Inc. or CMI. <br />5. As follows: <br />a. Page 3.7.4 attached. <br />b. Section 3.7-5 and 3.7-6 attached. <br />c. I've attached the new CMI NOV list and the last P&M list. How do you want <br />to see these? We've received two different guides. OSM does not want any of <br />the P&M information, they view CMI as a totally new company. The State of <br />Wyoming and State of Alabama want both lists, they view CMI as a name <br />change of the same operator.
