The Colorado Department of Public Health and Environment is the regulatory agency <br />responsible for the only other permit held for the Edna Mine. A copy of the certified <br />letter notifying them of a name change is attached. <br />2. A draft public notice is attached. <br />3. An updated chain of ownership and officers and directors of each company in the <br />chain are attached as part of the response to concern five of your letter. <br />4. As of August 1, 2007, The Pittsburg & Midway Coal Mining Co. (P&M) officially changed <br />its name to Chevron Mining Inc. (CMI). This change represents a change of name of the <br />existing corporation only. There has been no change to the ownership or structure of the <br />original corporation which continues to exist uninterrupted under the new name. Legally, no <br />action is required to assign, transfer, ratify or otherwise change any existing contracts, <br />licenses, leases or other legal documents pertaining to P&M as CMI is legally the same <br />company as P&M. If desired, CMI may be referred to as "Chevron Mining Inc. formerly <br />known as The Pittsburg & Midway Coal Mining Co." for clarity and convenience, however <br />this is not required. For additional clarification, reference should be made to the attached <br />copy of the official Certificate of Corporate Records documenting the name change. You <br />may also contact John F. Ashburn, Jr. in the CMI legal department for more information if <br />necessary. Mr. Ashburn can be reached at (303)930-4218.
