July 24, 2009 <br />Mr. James VanElla <br />Gold Basin Mine <br />180 Lane 200 Bass Lake <br />Angola, IN 46703 <br />RE: Gold Basin Mine, Permit No. M-1992-045, Annual Fee and Annual Report Request <br />Dear Mr. VanElla: <br />On June 1, 2009, the Division of Reclamation, Mining and Safety (Division) mailed the Annual Fee and <br />Report Request for the Gold Basin Mine to your attention. The request indicates that the annual fee and <br />annual report for this mine site are due on or before your anniversary date of July 21, 2009. <br />The request was promptly returned to the Division with a note indicating we "should contact Gold <br />Mountain Metals, Inc. as the permit was in their name". The returned request also had the anniversary <br />date of July 21st crossed out and a new date of December 26th written in. <br />Please be advised that the anniversary date is associated with the permit and is set on the issuance date <br />of the permit. It does not change when a succession of operators occurs. Since the July 21, 2009 <br />anniversary date occurs after you became the Permittee/operator for the Gold Basin Mine, the <br />responsibility for submittal of the annual fee and report falls to you. The Division understands that this <br />may have been misunderstood and has extended the due date for submittal of the annual fees and
