III. COMMENTS - COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
This was a complete of the Coal Basin Mine. Members of the Crystal Valley Environmental Protection
Association accompanied DRMS on a portion of this inspection.
The operating permit has been revoked at this site, and the reclamation bond has been forfeited.
Reclamation of the site is substantially completed. Only maintenance of previously reclaimed mining
areas remains to be completed.
The Sutey Refuse Disposal Area maintenance completed in the summer of 2008 was evaluated. To
date, the channel is functioning as designed, having passed the spring snowmelt uneventfully.
The Dutch Creek Diversion was examined for its length. The channel appears to be stable within the
confines of the outer channel. Migration of the inner channel continues to occur as designed. The
channel appears to have established a favored alignment near the more central segment. This
alignment appears to favor the easterly portion of the inner channel.
Development of the privately owned approximately 300 acres located between the confluence of Coal
and Dutch Creeks, and the Rock Tunnel area was observed from Road A. Much of the reclamation
work performed by the Division at this previously disturbed area has been substantially altered by the
landowner.
The Road D maintenance work appears to have successfully passed the spring snow melt. Little
additional erosion of the road base or outside fill slope was noted.
Vegetation at the reclaimed areas appears to be healthy at this time, however it is somewhat early in
the growing season to make a qualitative evaluation of vegetative success.
Most of the reclaimed mine facilities, including roads and slopes below the mine benches, were
evaluated during this inspection. The reclaimed areas were generally found to be functioning as
designed.
