III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete of the Coal Basin Mine. Members of the Crystal Valley Environmental Protection <br /> Association accompanied DRMS on a portion of this inspection. <br /> The operating permit has been revoked at this site, and the reclamation bond has been forfeited. <br /> Reclamation of the site is substantially completed. Only maintenance of previously reclaimed mining <br /> areas remains to be completed. <br /> The Sutey Refuse Disposal Area maintenance completed in the summer of 2008 was evaluated. To <br /> date, the channel is functioning as designed, having passed the spring snowmelt uneventfully. <br /> The Dutch Creek Diversion was examined for its length. The channel appears to be stable within the <br /> confines of the outer channel. Migration of the inner channel continues to occur as designed. The <br /> channel appears to have established a favored alignment near the more central segment. This <br /> alignment appears to favor the easterly portion of the inner channel. <br /> Development of the privately owned approximately 300 acres located between the confluence of Coal <br /> and Dutch Creeks, and the Rock Tunnel area was observed from Road A. Much of the reclamation <br /> work performed by the Division at this previously disturbed area has been substantially altered by the <br /> landowner. <br /> The Road D maintenance work appears to have successfully passed the spring snow melt. Little <br /> additional erosion of the road base or outside fill slope was noted. <br /> Vegetation at the reclaimed areas appears to be healthy at this time, however it is somewhat early in <br /> the growing season to make a qualitative evaluation of vegetative success. <br /> Most of the reclaimed mine facilities, including roads and slopes below the mine benches, were <br /> evaluated during this inspection. The reclaimed areas were generally found to be functioning as <br /> designed. <br />
