Dear Interested Person:
All parties to the above referenced application have withdrawn from party status. Therefore,
pursuant to Rule 2.7.3(5), the Colorado Mined Land Reclamation Board has directed this Office
to act on its behalf and to timely approve or deny the application.
On June 15, 2009, the Division determined that the Applicant had demonstrated compliance
with the requirements of Section 34-32.5-115(4) C.R.S., and issued its recommendation to
approve the application. Copy of the Division's written recommendation and rationale for
approval was provided to all parties and interested persons. The Division has reviewed the
record and has determined that its original recommendation remains valid. On July 24, 2009,
the Division approved the application for the Red Mesa Pit, File No. M-2009-023.
Therefore, the Pre-hearing Conference, previously scheduled for July 28, 2009, has been
canceled and the application has been withdrawn from the Board's August 2009 agenda. The
permit application is hereby approved but the permit will not be issued until the Division receives
and fully approves the performance and financial warranties.
