III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator during the field inspection or the records check. <br /> Reclamation - <br /> The reclaimed mine slopes were well vegetated and there were no indications of erosional problems or slope <br /> stability problems.No seeps were flowing on the reclaimed hill slopes.No stability problems with the reclaimed <br /> highwall were observed. The reclaimed haul road was stable as well. <br /> The vegetative growth on the seeded reclaimed ponds 4 and 5 is sufficient to control erosion and is comparable <br /> to the vegetative growth on adjacent areas(please refer to the two digital images on page 2 of this inspection <br /> report). The reclaimed pond 4 and pond 5 areas were the last two areas that needed appropriate vegetative cover <br /> to be established for final bond release under SL-2. The initial field inspection under SL-2 took place on August <br /> 27, 2008 and was for Phase II and Phase III bond release. <br /> There are a few reclamation activities that need to be performed before the Division can schedule a second bond <br /> release inspection. The remaining reclamation activities that need to be performed are: <br /> 1. Reclaim piezometers. <br /> 2. Remove survey stakes and pvc pipes. <br /> 3. Remove remaining black plastic culvert sections at reclaimed coal stockpile area. <br /> 4. Remove surface disturbance pvc pipe markers. <br /> 5. Remove silt fence from reclaimed pond 4 and pond 5 areas. <br /> 6. Spray Russian knapweed in the area next to reclaimed pond 4, and elsewhere on the mine site if observed. <br /> 7. Spray thistle plants on the reclaimed mine site. <br /> 8. Remove mine identification sign and records location sign from entrance gate. <br /> Roads <br /> The Hubbard Creek road was dry and in good condition. The entrance road to the reclaimed mine site was also <br /> dry and passable. The light use road leading to reclaimed pond 5 was passable, although weeds are beginning to <br /> grow on the road.The road is to remain after reclamation. <br /> Signs and Markers <br /> The mine identification sign and the records location sign were on the entrance gate and contained the required <br /> information. Surface disturbance markers were present around the disturbed area. <br /> 1 <br />
