HR. CU1VllV1ENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator,the Bear Coal Company, during the field inspection. <br /> Noxious Weeds <br /> There had been some recent work on removing tamarisk that is growing along the water's edge at the hillside <br /> spring water treatment pond. Tamarisk needs to be removed at the hillside spring area and near the entrance gate <br /> as well. <br /> Hydrology <br /> The water level in the hillside spring water treatment pond was about 8 inches below the horizontal pipe,which <br /> is the normal situation. The pond was discharging at about i 0 gpm. The discharge water was orange in color, <br /> which has been found to be in compliance with water quality standards. The water temperature of the hillside <br /> spring was 102 degrees Fahrenheit at a location that was about 10 feet below the point of origin on the hillside. <br /> There was only a little standing water in the sediment pond.The primary discharge gate on the pond was in the <br /> closed position.The pond embankment appeared to be stable.The collection ditch leading into the sediment <br /> pond had sufficient capacity. The riverside berm was in place.No problems were noted with the two alluvial <br /> wells. <br /> Facilities <br /> The entrance gate to the site was propped open.No new reclamation work has occurred at the former mine <br /> office site. Concrete foundation sections and the concrete pad were still on site. Several old tires were also in <br /> this area. <br /> Roads <br /> The paved haul road was passable and in good condition.There was no debris on the road. The cable guard was <br /> in place along the outside edge of the road. The bridge across the river was also passable. <br /> Signs and Markers <br /> The mine identification sign and its post at the top of the hill were on the ground and need to be put back up. <br /> The"no trespassing" sign was up on the entrance gate. <br /> c:/word2007/bear3/inspO70y <br />
