III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.Jim Kiger represented the <br /> operator during the field inspection and records check. There were no coal haul trucks being unloaded or coal <br /> railcars being loaded during the inspection.No crushing and screening operations were taking place either. <br /> Facilities <br /> There were no compliance problems with any of the facilities, including the loadout office area, substation,coal <br /> handling structures and the material storage area. There was very little stockpiled coal on the facilities bench. <br /> The facilities bench outside edge berm was functional and there was no evidence of fugitive coal dust going <br /> offsite.There were no fuel leaks at the fuel facility. <br /> Hydrology <br /> The east side sediment pond was dry. The gate on the primary discharge pipe was in the closed position. The <br /> pond embankment was well vegetated and appeared to be stable. The pond inslopes also were stable.The west <br /> side sediment pond was also dry. The single open channel spillway was in place. <br /> The culverts and ditches around the site were well maintained and had sufficient capacity. The silt fence and <br /> straw bales along the railroad track small area exemption were in place. <br /> Roads <br /> The paved main haul road was in good condition. The graveled east side entrance road was also in good <br /> condition. The east entrance gate was open. The light use road along the railroad tracks was dry and passable. <br /> Topsoil <br /> The west side topsoil stockpile had a good grass cover. The collection/diversion berm was in place around the <br /> stockpile. The topsoil stockpile sign was in place. The east side topsoil stockpile had a moderate cover of <br /> vegetation. The collection ditch and the diversion ditch had sufficient capacity. <br /> Signs and Markers . <br /> The mine identification signs were up at the required locations and contained the correct information. The <br /> permit boundary markers were also up around the loadout boundary. <br /> Records <br /> The records were in compliance, as shown on the attached records checklist. <br /> c:/word2007/terror/insp0709 <br />
