Colorado Division of Reclamation, Mining and Safety <br />To: Foidel Creek Min 8 ,TR68 <br />From: Janet Binns <br />Date: 8/3/2009 <br />Re: Phone Memo with Jim Komatinsky of DOW <br />Comments: Jim Komatinsky of Colorado Division of Wildlife called and left a message <br />on 7/27/2009 regarding Foidel Creek Mine TR68. I returned his call on <br />8/3/2009. Mr. Komatinsky requested a little more information regarding <br />what Twentymile Coal Company was proposing to do with TR68. <br />Specifically, he was concerned with surface disturbance and surface impact <br />since there is at least one identified sharptail grouse lek in general vicinity. <br />He had received an aerial photo with the proposed affected area on it as <br />well as the identified leks in the area. He wasn't sure if this aerial photo <br />had come from the operator or from someone else from DOW. I explained <br />what development of the gateroads entailed and that there would be no new <br />surface disturbance with this revision. I also explained that development of <br />these 2 gateroads were previously included in the PR8 that TCC had <br />submitted and that DRMS had also sent that information the DOW. <br />All activity associated with TR68 would be underground with no planned <br />subsidence. Mr. Komatinsky indicated that that clarification was very <br />helpful and would allow him to continue his review.
