Succession of Operator No.3, SO-3, Second Adequacy Review Letter
Dear Mr. Bear:
The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy
review of Bowie Resources LLC's (BRL) adequacy response letter dated July 14, 2009 for
Succession of Operator No. 3 (SO-3). The following is the status of the issues.
1. Under Rule 2.03.4(7), the entries on the coal ownership list on proposed revised page
2.03-7 do not coincide with the entries on the coal ownership list shown on Map 2, Coal
Ownership Map. Please reconcile the two lists.
There appears to be a discrepancy in the coal owner list between BRL's Map 2 and the
Division's Map 2, even though the revision date of July 26, 2007 is the same on both
maps. The Division's Map 2, approved in TR-47, lists 1) Bowie Resources Limited; 2)
Bureau of Land Management; 3) Wood, Deloris D.; 4) Norris, James A. & Caroline; and
5) Oxbow Carbon & Minerals as the coal owners. The Division requests that BRL send a
copy of its Map 2 to the Division.
2. Under Rule 2.03.6(1) on proposed revised page 2.03-12, reference is made to the right of
entry to property owned by the Wayside Farm and Cattle Company. However, this
company no longer appears as a surface owner on proposed revised permit page 2.03-5
or on proposed revised Map 1, Surface Ownership Map. In order to avoid any confusion,
please add a note to permit page 2.03-12 that explains that the property of the Wayside
Farm and Cattle Company is now owned by Norton Seybert Colorado Holdings, LLC.
This issue is resolved. BRL provided a revised page 2.03-12 that contains the requested
statement.
