Hydrological Connection Analysis <br />i. By April 30, 2009, the permittee must submit a draft Hydrological Connection Analysis Study Plan. The study plan <br />must identify the procedures and methods that will be used to determine the pathways of process water seepage from <br />the ponds along the Middle Fork of the Purgatoire River, specifically Ponds 1, 4, 6, 7 and 8 and their potential <br />confluence with the Middle Fork of the Purgatoire River. <br />ii. By June 30, 2009, the permittee must begin implementation of the Hydrological Connection Analysis Study <br />iii. By December 31, 2009, the permittee must submit conclusive results of the Hydrological Connection Analysis Study <br />that demonstrate the presence or the absence of a hydrological connection between seepage from Ponds 1, 4, 6, 7 and <br />8 and surface water. <br />conclusive results are trough does not <br />no further Analysis Sty indicate that tht <br />If the results ofhWa Hydrological <br />enter the surface > <br />If the results of the approved Hydrological Connection Analysis Study indicate that ground water seepage is <br />discharged to surface water via a hydrological connection or if the facility fails to conduct a conclusive study, along <br />with the study results, the facility must, also by December 31, 2009 (1) submit an implementation plan which <br />includes milestones for the completion of necessary actions (e.g., lining of the ponds, development of an alternate <br />• monitoring point) to ensure that discharge to surface waters, both in terms of volume and characteristics, are <br />monitored and reported; and (2) request a permit modification to reflect the implementation plan proposed for the <br />appropriate action(s) (e.g., installing pond liners). <br />b. Ground Water Protection <br />i. By June 30, 2009, the permittee must investigate and submit conclusive information on the seepage from Pond 6 to <br />determine if the allowable exfrltration rate of 10-6 cm/sec is exceeded. If liner integrity is the basis for determination <br />that the seepage meets the criteria, then the report must be prepared by a professional engineer registered in <br />Colorado. <br />ii. If the study indicates that Pond 6 exceeds the allowable seepage rate of 10-6 cm/sec, then by December 31, 2009, the <br />permittee must facility either (1) submit a work plan for the installation of a liner for Pond 6; (2) submit a workplan <br />for the installation of groundwater monitoring wells; or (3) submit a letter including a permit modification request, <br />stating that the point of compliance will be at the influent to Pond 6. <br />If the study indicates that Pond 6 discharges at a seepage rate less than 10"6 cm/sec, the remainder of this compliance <br />schedule will be deemed complete. <br />iii. If the study indicated that Pond 6 exceeds the allowable seepage rate of 10-6 cm/sec and the permittee has opted to <br />line Pond 6, the permittee must, by December 31, 2010, submit a report completed by a professional engineer <br />registered in the state of Colorado indicating that the liners have been replaced. The report must certify that the liner <br />material meets the allowable seepage rate of 10-6 cm/sec or less, and that the placement was accomplished according <br />to the manufacturer's requirements (i.e., all welds were tested and the liners were checked for holes prior to <br />backfilling). Further, the pernttee must submit a request for permit modification to eliminate both Outfall 033 <br />limitations and monitoring requirements and Monitoring Wells 050A-050D limitations and monitoring requirements. <br />• If the study indicated that Pond 6 exceeds the allowable seepage rate of 10-6 cm/sec and the permittee has opted to <br />install monitoring wells, the permittee must, by December 31, 2010, provide notice of well completion. <br />Additionally, if the permittee has installed more or less monitoring wells than those specified in the permit, the <br />permittee must submit a request for permit modification to add or eliminate extra groundwater monitoring wells' <br />compliance points.
