PUBLIC NOTICE COMMENTS <br />Written comments were received from the permittee during the public notice period. Copies of these comments will be made <br />available upon written request. Topical summaries of the comments and the response of the Division are provided below. <br />Comment 1: The Company offices have moved (new address given). <br />Response 1: This has been updated. <br />Comment 2: New Elk Coal Company (NECC) requests a quarterly reporting cycle for Ponds 004, 007 and 008 as frequency of <br />discharge does not warrant monthly reporting. Pond 004 has not discharged since at least 1991, and 007 and 008 discharge <br />only during major precipitation events. <br />Response 2: The DMR submittal has been changed from monthly to quarterly. <br />Comment 3: Mine wetter treatment Pond 1: Initially, water will be pumped from the mine at a rate of 2000 gpm, and if <br />necessary, additional pumps will be used to increase flows up to 4000 gpm. The renewal application projected a maximum <br />discharge of 6000 gpm, which will not be implemented. <br />Response 3: Note that in additional conversation with the permittee regarding the flow rates and the Na limit, it was determined <br />that the facility will only discharge at a maximum rate of 2500 gpm, as the facility will be unable to meet the Na limit at the <br />40 higher flow rate.
