" Ell D- <br />;1P2009 <br />uvision o`f r?(- ?U mat'OVD? <br />{Mining and Safety <br />This letter is in response to your letter dated April 24, 2009, requesting an amendment <br />to the approval of the Middle Poudre Combined Substitute Water Supply Plan ("SWSP") dated <br />March 17, 2009. The only amendment to the approved SWSP is the addition of depletions due <br />to evaporation from an unlined 8.9-acre pond exposed at the East Rigden Pit permit boundary. <br />All other consumptive uses at the Middle Poudre sites will remain the same as in the March 17, <br />2009 approval. <br />Lafarge leases the East Rigden Pit property from Flatiron Companies ("Flatiron"). The 8.9- <br />acre pond was mined sometime between 2001 and 2002; however, was mistakenly omitted from <br />the augmentation requirement at the East Rigden Pit since the East Rigden Pit permit boundary <br />was not properly identified by the Applicant.
