Peterson, P.E. <br />RE: Operator: Cripple Creek & Victor Gold; Cresson Project; File No. M-1980-244 <br />Section 30, Twp 15 S, Rng 69 W, 6th P.M., Teller County (central point) <br />CONDITIONS FOR APPROVAL <br />® The proposed operation will consume ground water by: ? evaporation, ? dust control, ?reclamation, <br />? water removed in the mined product, ? processing, ® other: industrial use for a ground water <br />pumpback system, where shallow ground water in Arequa Gulch is collected and returned to the zero <br />discharge ore processing circuit. The applicant has obtained well permit no. 64952-F for this pumpback <br />system. This well shall not be pumped unless operated in accordance with the conditions of permit no. <br />64952-F and the existing substitute water supply plan, currently valid through December 31, 2009, or a <br />court approved plan for augmentation, pending approval by the Division 2 Water Court in case no. <br />02CW122. <br />® The proposed operation may have potential impact on existing water rights near the project location. <br />The proposed project will not alter or impact the historic operation of existing water rights so long as it is <br />operated in accordance with the existing substitute water supply plan, currently valid through December <br />31, 2009, or a court approved plan for augmentation, pending approval by the Division 2 Water Court in <br />case no. 02CW122. <br />® The applicant has indicated plans to use other water for the ore beneficiation circuit, suppression of <br />fugitive dust, drilling, laboratory, sanitary facilities, and for various miscellaneous associated uses such <br />as vehicle washing and applying hydromulch for revegetation at the permit site. The source of water for <br />these uses is primarily the City of Victor, with the City of Colorado Springs providing back-up supply. <br />Applicant will need to document that this water was diverted in priority under a water right decreed for <br />such uses upon request. Applicant should contact the water commissioner for further information. <br />COMMENTS: The applicant may contact the State Engineer's Office with any questions.
