According to our records, the following problem was to be <br />resolved on or before July 30, 2009. Listed below are descriptions and corrective actions for the problem. Please <br />resolve the corrective actions and provide evidence of such resolution on or before September 3, 2009. <br />Please note that if the corrective action is not properly addressed, and evidence provided to the Division by the date <br />provided above, the listed problems could be escalated to the level of possible violations and would then be referred <br />to the Mined Land Reclamation Board for further action. <br />• Imported fill was placed in Phase 3 of the Bettger Gravel Pit prior to Division approval. According to Rule <br />3.1.5(9), it is the operator's responsibility to provide the Division notice of any proposed backfill activity <br />not identified in the approved Reclamation Plan. <br />CORRECTIVE ACTION: <br />• The operator will need to comply with the specifications of Rule 3.1.5 (9) regarding the onsite disposal of <br />inert fill and submit a Reclamation Plan revision as a Technical Revision to the permit. The Technical <br />Revision must include the required $216 fee to be considered filed by the Division. <br />If the problem has already been remedied, please provide evidence of its completion.
