Dear Mr. Carter:
The Division of Reclamation Mining and Safety (DRMS) received Nuvemco's amendment / conversion to the
application of the above referenced 110(2) application on April 13, 2009. Per Rule 1.8.1(3) the new decision
date for this application was set for September 15, 2009. Nuvemco has requested that the decision date be
extended to February 1, 2010 due to unforeseen economic circumstances. DRMS accepts the request with the
understanding that should conditions improve prior to that date Nuvemco will be submitting updated
information with a request to proceed with the review.
Please be aware that per Rule 1.4.1(9) the application process must be completed within 365 days of being
called complete or it shall be scheduled for a review by the Mined Land Reclamation Board. The 365 day limit
is April 15, 2010. To ensure that a Board hearing does not occur, DRMS must have the updated information in
hand no later than February 1, 2010 otherwise it may deny the application as deficient.
