MTC 1101(1); Illegal or Improper Passing CRS 42-4-1002 - 1005 or MTC 1003 and <br />1005; Driving While Ability Impaired or Driving Under the Influence CRS 42-4-1301. <br />This policy must include all vehicle operations both on the job and transportation to and <br />from the Project. Dismissal under this condition is required unless it is determined by <br />Urie Rock Company that sufficient mitigating circumstances exist that warrants a reduced <br />level of discipline. Urie Rock Company will notify the County in the event of such <br />determination. Disclosure to employees and discussion of this policy must be included in <br />regular company safety meetings and documentation that this requirement is being met <br />must be available for inspection following reasonable notice at the request of the Rio <br />Blanco County Planning and Development Department. Urie Rock Company must <br />notify subcontractors in writing or otherwise include in its subcontractor agreements a <br />requirement that subcontractors working on the Project will comply with this condition as <br />to its employees working on the Project. Documentation that Urie Rock Company's <br />subcontractors are required to comply with this condition must be available for inspection <br />following reasonable notice by the Rio Blanco County Planning and Development <br />Department or the Rio Blanco County Sheriffs Office. <br />21. Urie Rock Company must notify the County Planning and Development Department of <br />any spills of hazardous materials or mandated shutdowns because of emissions. <br />22. In the event Urie Rock Company intends the sale, lease, or otherwise transfer of the rights <br />and/or facilities covered under this Special Use Permit, the transferee must comply with <br />all terms and conditions of this Special Use Permit, including but not limited to <br />mitigation measures and all other requirements. Notice must be given to the Rio Blanco <br />County Planning and Development Department at least 30 days prior to the anticipated <br />date of transfer. Before transfer, the Transferee must execute written documentation <br />agreeing to be bound by all provisions of this Special Use Permit. Until the Transferee <br />executes said documentation, Urie Rock Company will remain responsible for <br />compliance with all the provisions of this Special Use Permit. The Transferee's failure to <br />execute such documentation coupled with Urie Rock Company's failure to honor its <br />continuing obligations are cause for revocation of this Special Use Permit. <br />If any section, subsection, sentence, clause, phrase or portion of this Resolution is, for any <br />reason, held to be invalid or unconstitutional by the final decision of any court of competent <br />jurisdiction, such decision shall not affect the validity of the remaining portions of this <br />Resolution. The Board of County Commissioners of Rio Blanco County, Colorado declares that <br />it would have adopted this Resolution and each section, subsection, sentence, clause, phrase, or <br />portion herein, despite the fact that any one or more sections, subsections, sentences, clauses, <br />phrases, or portions would be declared invalid or unconstitutional.
