WHEREAS, the application has been determined to be complete; and <br />WHEREAS, the Board closed the hearing and the record is deemed complete; and <br />WHEREAS, the Board of County Commissioners on the basis of evidence produced at <br />the aforementioned hearing has made the following findings: <br />1. The public hearing before the Board of County Commissioners was extensive and <br />complete, pertinent facts, matters, and issues were submitted, and any interested <br />parties were given an opportunity to be heard at the hearing; <br />2. The proposed Special Use Permit is in the best interests of the health, safety, morals, <br />convenience, order, prosperity and welfare of the citizens of Rio Blanco County. <br />THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Rio <br />Blanco County, Colorado, that a Special Use Permit, # 09-08, for the Urie Rock Company, Urie <br />Gravel Pit Project is hereby approved, subject to the following conditions: <br />1. Urie Rock Company must operate the gravel pit and perform the required reclamation in <br />accordance with the Colorado Division Reclamation, Mining and Safety (CDRMS) <br />limited impact, Section 112 Operation and Reclamation Permit. <br />2. Urie Rock Company must implement all mitigation measures described in the CDRMS <br />112 Permit application, the Special Use Permit application and the supporting documents. <br />3. Urie Rock Company must control dust within State particulate emissions limits both <br />within the pit and on the haul road to its junction with County Road 46. <br />4. Normal hours of operation will be 6 a.m. to 6 p.m., Monday through Saturday. No night <br />mining activity or Sunday operations are allowed. Operations outside of these hours <br />require prior approval from the Development and Planning Department. <br />5. Urie Rock Company must remove any mud or material spilled onto County Road 46 <br />immediately upon discovery. <br />6. Urie Rock Company must maintain a buffer of at least 100 feet between any wetlands and <br />the outer edge of any disturbance from this project. <br />7. Weeds must be controlled in accordance with the weed management standards stated <br />within the SUP application and to County Land Use Resolution standards. <br />8. Any deviation from the mining and reclamation plan described in the SUP application <br />require prior approval of the Rio Blanco County Development and Planning Department. <br />2
