<br />Please feel free to contact Janet Binns at 303-8664944 if you have any questions regarding her <br />estimate. <br />Adequacy Review <br />The Division has conducted an adequacy review of the NOI Amendment in accordance with the <br />applicable provisions of the Act and the Regulations. We have the following adequacy questions: <br />I . Under the "Permittee" section of the NOI Amendment application form, both the "Individual's <br />Name" and the "Company Name" were filled in. In accordance with the requirements of <br />Regulation 2.02.2(2)(a), we prefer that only one of these blanks be filled in. Please therefore <br />submit a revised NOI Amendment application page identifying which entity should be <br />identified as the "Permittee". <br />2. In accordance with the requirements of Regulation 2.02.2(2)(b), please provide the name, <br />address, and telephone number of the "representative who will be present at and responsible for <br />conducting" the drilling, completing, logging, and reclamation of the six boreholes proposed <br />under the NOI amendment. <br />3. It is stated on the first page of the June 18, 2007 cover letter that the Amendment to the NOI is <br />for "...drilling and sampling of up to 5 additional coreholes...". However, the text of the <br />Amendment application indicates that six boreholes are being proposed (BEHWOOI- <br />BEHWO06). Please address this apparent discrepancy. <br />4. It is stated on the first page of the June 18, 2007 cover letter that "The proposed exploration <br />program modifications involve completion, sampling, and geophysical logging of 5 additional <br />coreholes (total of 38y'. However, the text of the Amendment application indicates that six <br />boreholes are being proposed, rather than five as mentioned in the cover letter. Additionally; as <br />the original NOI approved 33 boreholes, six new boreholes would raise the new total to 39. <br />Please address. <br />5. Regarding the 33 boreholes approved under the original NOI, borehole BLM032 appears to be <br />missing from the version of Table 1 submitted with the Amendment application. Please <br />address. <br />6. In accordance with the requirements of Regulations 2.02.2(2)(f) and 4.21.4(3)(a), please <br />modify the text of the NOI Amendment in the "Site Development, Exploration Access" section, <br />to include the following statement: <br />"Vehicular travel on other than established graded and surface roads will <br />be limited to that absolutely necessary to conduct the exploration. Travel <br />will be confined to graded and surfaced roads during periods when <br />excessive damage to vegetation or rutting of the land surface could result."
