Cattany <br />Division Director <br />Natural Resource Trustee <br />Robert Ray <br />Lafarge West, Inc. <br />10170 Church Ranch Way, Suite 200 <br />Westminster, CO 80021 <br />Re: River Valley Resource, Permit No. M-2001-090, Surety Release Request Procedure <br />Dear Mr. Ray, <br />The Division of Reclamation, Mining and Safety noted Lafarge West, Inc inquired about releasing <br />the reclamation permit for the River Valley Resource site, Permit No. M-2001-090, in the July 29, <br />2009 Annual Report. <br />The full release of a permit is explained in Rule 4.17 of the Construction Materials Rules and <br />Regulations. A copy of the Rule is enclosed for your review and reference. Please be sure the <br />request is sent certified mail and separate from any other correspondence. <br />The important question a permit holder must ask is does a site meet the approved reclamation <br />permit? If a site does not meet the approved plans, staff cannot by rule release the site <br />regardless of any landowner acceptance or approvals. Weather may soon be a factor at the site. <br />An inspection cannot be done unless the site is relatively free of snow cover.
