III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division) on 20 July 2009. The purpose of this inspection was to <br /> evaluate the on-the-ground condition with respect to Edna Mine's Phase I, II, and III (SL-10) and <br /> Phase II and III (SL-11) bond release applications, in accordance with Rule 3.03.2(2). The inspection <br /> was attended by the following: <br /> Janet Binns of CDRMS <br /> Christine Belka of OSM <br /> Steven Leach of Chevron Mining (operator) <br /> Troy Summers of WWC Engineering (operator consultant) <br /> Lori Jazwick of NRCS <br /> Sarah Hagenbach of NRCS <br /> Tom and Leslie Maneotis (landowner) <br /> Rob and Kathryn Dick (landowner) <br /> Scott Hayden (representing landowners) <br /> It is noted that Lori Jazwick, Sarah Hagenbach, and Rob and Kathryn Dick left the bond release <br /> inspection at the conclusion of the SL-10 portion of the inspection. <br /> The weather was clear and the ground was dry during the on-the-ground inspection of the site for the <br /> morning with raining and wet conditions in the afternoon. All areas to be inspected were accessible <br /> and visible. <br /> Lands requested for liability release under SL-10 include 13.3 acres of land reclaimed in 2003. Lands <br /> requested for liability release under SL-11 include 1197.6 acres of land reclaimed during '1981 <br /> through 1996. Surface land ownership is private and Federal. Sub-surface ownership is both Federal <br /> and private. Representatives from the Office of Surface Mining and the Bureau of Land Management <br /> were notified with OSM accompanying the inspection and BLM declining to attend. <br /> Hydrologic Balance <br /> The reclaimed Tipple Ponds and the permanent sediment trap configuration along the lower tipple <br /> road of SL-10 were inspected and found to be in good condition. No evidence of erosion features or <br /> damage was noted in the drainage. The sediment trap configuration included some random pieces of <br /> steel pipe within the trap that will need to be removed prior to the release of SL-10. <br />
