Ill. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division) on 13 July 2009. The weather was clear during the on- <br /> the-ground inspection of the site with rain accumulating in the afternoon. Graham Roberts of TMI <br /> accompanied the inspection. The ground was dry during the onset of the inspection and becoming <br /> wet with the rainfall at the time of the inspection. <br /> Trapper continues to progress with mining in the F-Pit and Z-Pit. <br /> Roads <br /> All haul roads were dry and stable at the time of the inspection. All haul road side ditches were <br /> functioning as permitted during the rain event at the time of the inspection. Adequate runoff was <br /> noted with no signs of damage or erosion. Access roads were wet with access to the ponds. All <br /> access roads appeared to be stable with no damage noted with the exception of the West Pyeatte <br /> sediment pond access road. <br /> This access road will require grading in order to provide adequate runoff from the road. <br /> Hydroloaic Balance <br /> Ponds were being monitored by Graham Roberts of TMI during this inspection. Four ponds were <br /> discharging during the inspection. <br /> • No Name appeared stable with no problems noted. No Name contained water and had a <br /> discharge rate of .18, pH-8.3, 24C and 2430 conductivity. <br /> • Middle Flume contained water and was discharging through the 1" Baski flume pH at 9.0, 26C, <br /> and 2910. <br /> • Johnson contained water with a trickle discharge and pH at 8.8, 26C and 2910 conductivity. <br /> Middle Flume and Johnson were being treated with CO2 for elevated pH levels. <br /> All pond embankments were stable with no problems noted at the time of the inspection. All spillways <br /> were in compliance at the time of the inspection. <br /> Trapper Mine was operating as permitted, with no major problems or maintenance issues noted at the <br /> time of the inspection. <br />
