III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the Munger Canyon Mine conducted by Mike Boulay of the DRMS <br /> Grand Junction Field Office on July 7, 2009. I was not accompanied by an operator representative <br /> during the inspection. Weather conditions were warm, clear and dry. Ground conditions were dry. <br /> The majority of the mine site is reclaimed and there was no activity at the site. <br /> Roads <br /> The access road to the mine site was dry and the road was in good condition. No problems were noted <br /> along its entire length up to the former portal bench access road. <br /> During the last inspection(see inspection report date 06/04/09), I was informed by a representative of <br /> XCEL Energy that they were installing a new gas pipeline that will be buried. The pipeline will cross <br /> a very small section of the permit boundary on private surface, essentially the width of the access road. <br /> As seen in attached Photograph No. 1 (view to south), the excavation for the pipeline has not impacted <br /> the mine site access road. Photograph No. 2 shows the view to the north of the mine access road. The <br /> pipeline trench has been backfilled on either side of the road and the area is stabilized. Silt fence <br /> (Photograph No. 3)has been installed by XCEL on both sides of Munger Creek in proximity to the <br /> pipeline trench. <br /> Hydrologic Balance <br /> East Salt Creek was flowing with turbid water. Munger Creek was damp in spots along the lower <br /> reach above East Salt Creek. The waste disposal area sediment pond was dry and stable. <br /> Processing Waste <br /> The waste disposal site(including the waste disposal cell and adjacent cover and topsoil stockpiles) <br /> appear stable. No problems were noted with this site inspection. <br />
