M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection of the McClane Canyon Mine conducted by Mike Boulay of the Division <br /> of Reclamation, Mining and Safety(DRMS) on July 7, 2009. I was not accompanied by an operator <br /> representative during the inspection because it was mine vacation week and only very few of the staff <br /> were present at the mine. Weather conditions were clear and warm. Ground conditions were dry. <br /> There was very little activity at the mine site. There was no coal being conveyed out of the mine and <br /> no coal being hauled from the site. <br /> Roads <br /> Roads were maintained and in good condition throughout the site. Road ditches are adequately <br /> maintained. Culverts were clear of sediment and debris and functioning properly. Although there <br /> were no haul trucks operating, the mine haul road was being watered for dust suppression. <br /> Hydrologic Balance <br /> Drainage structures and diversion culverts in the portal area were clear of debris and appeared to be <br /> functional. The catchment basins for the large diversions at the upper end of the portals area were dry <br /> and well maintained. The mine was not discharging water at the time of the inspection. The sediment <br /> pond was containing muddy water at approximately the level of the principal spillway,but the pond <br /> was not discharging. All other site sediment control features appeared to be in good working order. <br /> Processing Waste <br /> The temporary coal waste pile area was inspected and found to be properly maintained. The berm <br /> around the waste pile is in good condition. No problems were noted at any of the mine site facilities <br /> during this inspection. <br />
