Box 596 <br />Fort Morgan, CO 80701 <br />RE: • Morgan Sand and Gravel <br />Use by Special Review <br />SE1/4NW1/4 and SW1/4NE1/4, Section 34, T5R58W of the 6'h PM <br />Dear Ms. Gorrell: <br />We, the under signed, are filing a complaint against Morgan Sand and Gravel for violating <br />regulations: <br />a). 4-730 for the improper disposal and operation of Hazardous Waste <br />facility, <br />b). 4-630 for Depositing Junk or Waste on Another's Property. <br />including 4-565 and 4-575 <br />c). 4-290 for endangering the Health of Animals. <br />In addition to the regulation violations, Morgan Sand and Gravel has also violated Paragraph 2, <br />subpart a and Paragraph 3, subpart c of Resolution 2008 BCC 52, <br />Attached is a letter from our attorney outlining the sequence of everyts surround the illegal <br />dumping of the hazardous waste on our land. <br />Recently, the hazardous material has been removed. In the process of removal, we believe <br />that an individual from Morgan Sand & Gravel entered our land, without our permission, to <br />remove the hazardous material. John Longacre, on March 2, 2009 filed a trespassing <br />compliant against unknown employees of Morgan Sand and Gravel, Case number <br />200900000228. <br />It is our opinion that Morgan County Sand and Gravel has exceeded the Special Use Permit as <br />granted under, regulation 3-200 to stock pile asphalt and concrete for recycling. We are also of <br />the opinion that other materials, besides concrete and asphalt are being stored or buried on the <br />property.
