EXHIBIT B <br />MORGAN COUNTY COMMISSIONERS <br />Messrs. Schell and Scen Har*Envii COMPLAINT MORGAN SAND AND GRAVEL <br />March 16, 2009 <br />encountered. Pieces of PVC plastic, Styrofoam, cans, sheet metal, bricks, broken concrete and <br />rope were observed in the soil. Photos 13-24 provide evidence of the solid waste debris found in <br />the excavation. <br />Excavation #2 is located approximately 50 feet east of #1, and was excavated in the same manner. <br />The amount of solid waste debris observed was considerably less than that found in excavation # 1. <br />Native soil was encountered after 3-5 feet of overburden fill soil was removed. Photos 10-12 <br />provide evidence of the solid waste debris found in the excavation. <br />We then walked the vicinity. southeast of the excavation and John Longacre pointed out other solid <br />waste debris that was scattered across the area. Pieces of fiberglass sheets, cans, foam board and <br />roofing tar-paper scraps were observed. <br />The inspection team then moved to. the north side of the Westhoff property to examine the two <br />piles of construction rubble where asbestos containing material was documented during my <br />November 19, 2008 sampling event.. Based on the disturbance of the surface by tire tracks and <br />scraping marks, it was obvious.to everyone that both piles had recently been moved about 20-30 <br />feet south, from the Longacre to the Westhoff property (see Figure 1 and Photos 7 & 8). We <br />stood on the Longacre property while I described the condition of the piles and the types of <br />construction debris that were collected, for asbestos analyses. To emphasize the -waste disposal <br />conditions that have been observed on the Westhoff property, Mr. Longacre produced numerous <br />photographs and reviewed them with Ms. Smith and Mr. Dearborn. <br />We then drove back to the starting point. Prior to departing, Ms. Smith and Mr. Dearborn said <br />they would consider all that they have' seen and review the data and pictures with their supervisor. <br />They assured Mr. Longacre they. would be getting back with him in the near future. <br />Following their departure we went back_to the original excavation and I collected samples of the <br />solid waste debris that was exposed. At the request of Mr. Longacre, I also collected four material <br />samples for asbestos content and one soil sample for arsenic, chromium and lead analyses. All of <br />the asbestos samples were reported as "none. detected", and the metals analyses were very low <br />(chromium 3.8 mg/Kg) or not detected.
