however, the Division could not locate any structure(s) owned by Anadarko on the Extraction <br />Map. Please identify and label the structure owned by Anadarko on all applicable maps. In <br />addition, please locate and label all of the utility structures that are within 200 hundred feet <br />of the affected land, including overhead power lines and buried utilities. <br />6.4.4 Exhibit D - Mining Plan <br />4. The Mining Plan states that mined materials will be conveyed to the Kurtz Project plant via a <br />conveyor connecting the Heintzelman Project (Pit 116) to the Kurtz Project Plant. Upon <br />reviewing the Applicant's request to omit the conveyor route from the affected area, the <br />Division has concluded that the conveyor route must be included in the affected area of the <br />Heintzelman Project (Pit 116). The definition of affected land is intentionally broad in order <br />to encompass the variety of disturbances that result from mining operations. The conveyor <br />route, whether viewed as a form of transportation or equipment resulting from the mining <br />operation, will cause a surface disturbance as a result of the mining operation. Therefore, the <br />conveyor route will need to be included into the permit area. <br />Adding the conveyor route to the permit area will increase the acreage of the affected land <br />which will require an amendment to the permit application. The Applicant may amend a <br />permit under consideration by the Office by filing a copy of such amendment with the Office <br />and placing a copy with the County Clerk and Recorder. The amendment shall constitute a <br />new filing for the sole purposes of determining the date for consideration of the application <br />by the Office, and for the deadline for a final decision of the application. Should the <br />Applicant choose not to include the conveyor route into the permit area, then all applicable <br />exhibits should be revised to reflect this change. <br />5. The Mining Plan states the final slope will be 3H:1 V down to a depth of 10 feet below the <br />normal water level. Please specify the anticipated water elevation for the reservoirs. <br />6. The Applicant has indicated the pits may be lined immediately prior to release. Please note <br />the lining of the pits could result in potential impacts to the hydrologic balance which would <br />have a significant effect on the approved or proposed Reclamation plan. Such a significant <br />effect would require an amendment to the permit. In addition, the Applicant would be <br />required to demonstrate that the water level of the reservoirs would be maintained at a certain <br />depth or range of depth in order to conform to the requirements of Rule 3.1.5(7). <br />7. The Applicant has stated plant and processing facilities will be constructed within the permit <br />area and that the proposed plants may remain after reclamation is complete. Please note that <br />any buildings that are to remain after reclamation must conform to local building and zoning <br />codes per Rule 3.1.11. Since it is the intent of the Applicant to include these structures in the <br />permit area, their location must be specified prior to Division approval of the permit <br />application. Please list and locate on the applicable exhibits all structures that will be <br />constructed on the site and provide their associated dimensions and composition in order to <br />accurately estimate the cost of removal. Any change in location of the structures can be <br />addressed through a Technical Revision in the future.
