OTHER PERMITS AND LICENSES REQUIRED EXHIBIT M <br />The following permits are needed for the site: <br />1) County Specific Development Permit - A.J. Botti Construction and Gravel has a <br />grandfathered specific development permit for the existing 7.57 acre permit area. An amendment <br />to the specific development permit was approved in July 2009. The development agreement is <br />included in this exhibit. <br />2) NPDES combined process water/storm water discharge permit - A NPDES permit will not be <br />needed from the Colorado Department of Public Health and Environment since water will not <br />leave the site until vegetation is sufficient to control erosion. <br />3) APEN - A fugitive air emissions permit may not be needed from the Colorado Department of <br />Public Health and Environment since the site will mine less than 70,000 tons per year. The <br />APEN is required to be submitted but has not yet been submitted for the site. <br />4) A Substitute Water Supply Plan for the Division of Water Resources is not needed for the <br />operation since irrigation water will not be used for industrial purposes. The water for dust <br />suppression comes from a water right in Seep Creek. <br />5) A County Road Access Permit will not be required for vehicles entering Sundown Road since <br />this activity is currently permitted through the grandfathered specific development permit. <br />6) A Spill Prevention Control and Countermeasure (SPCC) Plan is not needed for the mining <br />operation since the only tanks that will be located on site will be associated with the individual <br />processing plants. At times when there are no tanks on site with the processing equipment, fuel <br />will be brought to the site with a mobile fueling truck.
