YAK' <br />CORPORATION <br />June 29, 2009 RECBW® <br />Colorado Department of Health JUL 2 3 2009 <br />Water Quality Control Division <br />WQCD-P-132 Division of Reclartiatiow, <br />4300 Cherry Creek Drive South Mining end Safety <br />Denver, CO 80246-1530 <br />RE: Submittal of May 2009 Discharge Monitoring Report <br />To Whom It May Concern: <br />Energy Fuels Resources Corporation (Energy Fuels) is providing the attached Discharge <br />Monitoring Report (DMR) for the month of May 2009. The Whirlwind Mine water <br />treatment plant is located at 30100 5110 Road, Gateway, Colorado 81522. Discharge of <br />treated water from the Whirlwind Mine is allowed in accordance with Colorado <br />Discharge Permit System (CDPS) permit number CO-0047562. <br />Due to laboratory quality control issues with discharge sample, the sample underwent <br />several reruns. As a result, this DMR is being submitted past the due date (June 28, <br />2009). The final data presented in this DMR passed all laboratory internal quality control <br />requirements. Energy Fuels made Mrs. Kelly Morgan (WQCD Enforcement Unit) aware <br />of this situation on June 25, 2009 when it became apparent that the DMR would be <br />submitted past the deadline. <br />In addition, note that this DMR is signed by Jeff Osborn, General Manager for Energy <br />Fuels' Colorado and Utah Operations. Also attached is authorization for Mr. Osborn to <br />sign all reports and other information in relation to the Whirlwind Mine CDPS discharge <br />permit, signed by Stephen Antony, Executive Vice President and Chief Operating Officer <br />for Energy Fuels. <br />On November 24, 2008 the Whirlwind Mine was put on stand-by status. At this time, the <br />mine will continue to be dewatered during stand-by and Energy Fuels will continue to <br />treat and discharge mine water and to comply with CDPS permit conditions. Mine water <br />collects in the mine at a slow rate (approximately 2 to 3 gpm) and is being pumped into <br />the untreated water tank and treated in batch runs, as necessary. Currently, batch runs are <br />occurring at a rate of approximately one run per month. One batch run occurred from <br />May 18 to 21, 2009.
