Offsite Damage Update - Yule Marble Quarry, Permit M-1999-058 June 30, 2009 <br />Page 2 of 2 <br />The only quarry work we noticed concerning the damaged areas was the <br />placement of absorption booms on our property at the bottom of the rubble pile. <br />But the quarry did this without our permission. And more importantly, we will not <br />allow the quarry to turn our property into a slurry settlement pond fir its marble <br />quarry operations. The booms and the slurry must be removed from our property. <br />We need some answers here. The damages are now well in excess of the <br />original $18,829.00 cost estimate we gave you. We are unable to open the Trail, <br />which we operate as a summer and fall business attracting thousands of visitors <br />each year (see marblequarrytrail.com). This means an additional $500 per day in <br />damages for every day the Trail remains closed. <br />Therefore, we need a written plan from you and the quarry as to how and when <br />all these issues will be addressed - the debris on the cliff, the debris on the Trail, <br />the damages expenses, the slurry on our property and ongoing slums and debris <br />containment. We can't fix the bridges until the quarry clears away all the hanging <br />debris on the cliff. And we can't open the Trail until the bridges are repaired and <br />the debris no longer poses a safety hazard. Plus, hundreds of trespassers will <br />likely get into active quarry areas until the Trail is reopened. <br />If at all possible, we would like you to come back and inspect the areas that <br />you could not get to on May 26th. At that time we can also provide you with the <br />surveyor plats and legal descriptions of the properties, which were ordered by the <br />court in 2001, if there are any boundary questions.
