replaced, by running the equipment over the backfilled area during placement of successive lifts. <br />Following backfilling, disturbance areas will be graded to approximately their original configuration <br />and drainage will be reestablished. If the drill site or trenched area was an existing road or other <br />existing disturbance area, the disturbed configuration will be reestablished if needed for future <br />operations and the area will not be immediately reclaimed. For other exploration disturbance areas, <br />reclamation will be completed by scarifying the regraded surface, redistributing stockpiled topsoil, and <br />reseeding the area. <br />2.02.6 - General Coal Exploration Compliance Duties <br />Oxbow will conduct all exploration and related activities in full compliance with applicable regulatory <br />requirements. In order to assure compliance, the supervising geologist or engineer will be familiar <br />with relevant regulatory performance standards and will cooperate fully with authorized CDRMS <br />personnel. The supervisor will also be responsible for preparation and submittal of required reports, <br />including the certificate of completion, which will be filed per Section 2.02.6(3)(h)(ii), for each <br />exploration program upon completion of trench or drillhole abandonment and reclamation of related <br />disturbance areas. <br />2.02.7 - Sale of Coal for Testing Purposes <br />Oxbow does not anticipate that any coal extracted in conjunction with exploration activities will be <br />sold for testing purposes. <br />2.02.8 - Public Availability of Information <br />Except in such circumstances where Oxbow determines that disclosure of exploration information <br />may effect the company's competitive rights, exploration information submitted to the CDRMS under <br />applicable provisions of this section will be filed with the permit application in the County Clerk and <br />Recorder's Office. This information will be available for public inspection unless Oxbow requests <br />and the CDRMS issues a determination of confidentiality. <br />RN-5 2.02-4 Revised October 2008
