<br />6. Upon completion of all mining and reclamation activities at • <br />Seneca Mine, and upon release of all reclamation obligations and <br />liabilities by appropriate governmental agencies, PEABODY shall, at the <br />request of EPPS and HUDSONS, leave Peabody Seneca Mine Pond 006 in place <br />and assign the water right decreed thereto to EPPS and HUDSONS, provided <br />that all applicable rules, regulations and laws permit such pond to remain <br />in place. EPPS and HUDSONS shall thereafter assume any and all rights, <br />obligations and liabilities associated with such pond and water right, at , <br />no expense to PEABODY. <br />7. This Agreement shall not affect any rights or obligations of <br />PEABODY, EPPS or HUDSONS under the Coal Mining Lease dated July 2, 1974. <br />8.
