Pagel 7 <br />Response: Precision Excavating, Inc. will use its current Sand and Gravel Discharge Permit #COG- <br />500000 at facility #COG-500396 to add two addition outfalls for water discharge. The first outfall <br />discharge will be a groundwater application. The second outfall will be discharged directly into the <br />Yampa River and will be added once enough material has been mined to install sedimentation <br />ponds. The Colorado Department of Public Health and Environment Water Quality Division will <br />need exact coordinates of the outfalls to be able to list them into the permit. Precision Excavating, <br />Inc. will survey the exact points of the location of the outfalls and apply for an amendment to the <br />current discharge permit once the Division has approved the 112 permit amendment. Precision <br />commits to provide the Division a copy of the amended Sand and Gravel Discharge Permit. <br />Rule 6.4.12 Exhibit L - Reclamation Costs <br />25. Comment: The Division will estimate the cost to reclaim the site based on the information submitted on <br />June 16, 2009 and once the applicant addresses the concerns noted in this letter. In addition, the Division <br />will include costs to reclaim the site not included in the applicant's estimate. <br />Response: Acknowledged. <br />26. Comment: Since mining and reclamation at this site includes dewatering of the pits, the bond calculation <br />for the site should include costs related to dewatering of the largest affected pit to account for the costs that <br />would be incurred by the State if water had to be removed from the pit in order to establish the proper <br />reclaimed slopes along a pit wall. <br />Response: Acknowledged. <br />Rule 6.4.13 Exhibit M - Other Permits and Licenses <br />27. Comment: The applicant stated in a letter dated June 16, 2009, a Gravel Pit Well Permit and a 404 Permit <br />Application are being prepared by the applicant. The applicant acknowledged that a Well Permit must be <br />obtained before exposing groundwater in the expansion area and committed to not disturb the wetlands <br />prior to receiving a 404 Permit from the Corps. Please commit to providing a copy of both permits to the <br />Division before engaging in either activity. <br />Response: The applicant commits to providing a copy of both permits to the Division before <br />engaging in either activity. A copy of the Gravel Pit Well Permit application is included for your <br />records. <br />28. Comment: Please commit to providing the Division with a copy of the Routt County Floodplain Permit for <br />the Camilletti Milner Pit #2 amendment area. <br />Response: The expansion area is not located within the FEMA designated floodway, only the flood <br />fringe. No permanent structures are proposed within the expansion area. Therefore, the County did <br />not require a Floodplain Permit for the project. <br />Rule 6 4 14 Exhibit N - Source of Legal Right to Enter <br />29. Comment: Provide the Division with a copy of the sources of the applicant's legal right to enter and <br />initiate a mining operation in the amendment area. The applicant stated a copy of the State Land Board <br />lease was provided with the amendment application. The State Land Board lease was not submitted with <br />the amendment application. <br />Response: An authorization letter from Camilletti and Sons is included. A copy of the State Land <br />Board lease is also included. <br />Rule 6 4 18 Exhibit R - Proof of Filing with County Clerk and Recorder <br />30. Comment: Provide the Division with proof of filing revised application and maps dated May 14, 2009 with <br />the County Clerk and Recorder. <br />Response: This response letter, all attachments, and revised maps dated July 21, 2009 have been <br />filed at the Routt County Clerk and Recorder. A copy of this receipt is included. The revised <br />application and maps dated May 14, 2009 were inadvertently not filed with the County Clerk and <br />Recorder. The changes included in the May 14`h set are reflected with the most recent map revisions <br />which are now on file with the Clerk and Recorder.. The revised application and maps dated May <br />`h <br />14, 2009 have been on file with the Routt County Planning Department since May 14.
