The following are responses to each comment: <br />1. Comment: The Division requires the company name listed throughout... This item has been resolved. <br />Response: Per comment this item has been resolved. <br />2. Comment: The Division sent an Adequacy Review letter dated May 29, 2001...The item has been <br />resolved. <br />Response: Per comment this item has been resolved. <br />3. Comment: As required by Rule 1.6.2 (1)(e), please submit proof of public notice circulated to all owners of <br />record of surface lands, mineral rights and easement holders... Please submit the return receipts for these <br />notices to the Division along with proof of notice to all owners of record of surface lands and mineral <br />rights within 200 feet of the boundary of the affected land. <br />Response: The only owner of surface lands within 200 feet of the affected land (existing pit area and <br />expansion area) is Gary L. Neal. The easement holders on the affected land or within 200 feet are <br />Xcel Energy and Yampa Valley Electric Association. There are no known mineral rights holders on <br />the affected land or within 200 feet. Notices were sent to the above surface land owner and easement <br />holders. Copies of the return receipts are included in this package. Other surface land owners that <br />are nearby the gravel pit, were involved with the original gravel pit permit process, and that own <br />lots in the Saddle Mountain Ranchettes Subdivision that have views of the gravel pit were also sent <br />notices out of courtesy. Included is an Assessors Map showing the parcels in and adjacent to the <br />gravel pit. <br />4. Comment: The Division received comments from the Colorado Historical Society, Colorado Division of <br />Water Resources, and Routt County Conservation District. The letters are attached for your review. Please <br />address the comments noted in the letters and make any changes in the application as necessary. <br />Response: We have reviewed the Colorado Historical Society letter dated March 18, 2009 and the <br />applicant agrees that should human remains be discovered during mining activities, the <br />requirements under State Law CRS 24-80 part 13 apply and must be followed. We have reviewed <br />the Response to Reclamation Permit Application Consideration from the Division of Water <br />Resources dated March 24, 2009. The applicant understands that a gravel pit well permit is <br />required. The applicant submitted a gravel pit well permit to the Division of Water Resources on <br />July 14, 2009. A copy of the permit application is included. There are no existing wells within 600 <br />feet of the permit area. We have reviewed the Routt County Conservation District letter dated <br />February 23, 2009. This letter was also provided to the Routt County Planning Department during <br />review of County Special Use Permit and all comments were addressed. Reclamation of all slopes to <br />a 3:1 minimum is shown on the maps.
